
REGULAR SEMI—MONTHLY MEETING
November 27, 2001
The regular semi—monthly meeting of the Board of Supervisors, Hanover Township, Northampton County, Pennsylvania, was called to order by Vice—Chairman John J. Finnigan, Jr. at the Hanover Township Community Center located at 3660 Jacksonville Road, Bethlehem, Pennsylvania, 18017 at 7:30 P.M.
Present were Supervisors Colon, Walbert and Diacogiannis, Engineer Birdsall, Solicitor Broughal, Manager Sterner and Public Works Supervisor Kevin Healy.
Upon motion of Mr. Colon, seconded by Mr. Diacogiannis, the Board unanimously approved the Agenda.

Upon motion of Mr. Walbert, seconded by Mr. Diacogiannis, the Board unanimously approved the minutes, as written, from the meeting of the Board of Supervisors dated November 13, 2001.

Upon motion of Mr. Diacogiannis, seconded by Mr. Colon, the Board unanimously approved the List of Bills and Transfers dated November 27, 2001 as prepared by the Secretary/Treasurer, and to enter the signed List of Bills by the Secretary/Treasurer and the Board of Supervisors as an attachment to the minutes.

Mr. Walter Lysaght, member of the Board of Governors for the Airport Authority was present to thank the Board for petitioning the County Executive for his re—appointment since his term is to expire. Mr. Lysaght also credited the Township Road Crew for the terrific job that they do.
DEVELOPMENTS
Mr. Colon moved that the Board approve, based on the recommendation of the Township Engineer, that the Board grant the Developer's request for a reduction in the Subdivision Bond for DeLuca Homes, in the amount of $1,080,000.00, on the following conditions:
- That the request to reduce the Subdivision Bond be acceptable to the Township Solicitor.
- That the Subdivision Bond be maintained at a minimum amount of $1,133,800.00.
- That the Letter of Credit shall be maintained at the current amount of $100,000.00.
- That the Developer adhere to Township Policy #25 (payment of Plans and Appeals Account charges).
Also, to notify the Developer of the Board's action.

Chairman Salvesen arrived at 7:36 P.M.
Attorney Brian Johnson and Mr. James Rothdeutsch from The Pidcock Company were present representing Northgate I Conditional Preliminary Plan.
It was noted that the Developer has agreed with and signed the conditions.
Mr. Colon moved that the Board approve the Preliminary Plan for Northgate, 2 Lot Business Park Subdivision, dated as last revised November 9, 2001 upon the following conditions:
- The Developer/Owner agrees that no construction shall begin until approval of the Soil Erosion and Sedimentation Control Plan and Narrative is approved by the Northampton County Conservation District and a General N.P.D.E.S. Permit is provided. (SALDO Section 501.5.6)
- The Developer/Owner shall provide "certification from the sanitary sewer supply utility that the proposed sewage flows are within their capacity and that they would provide such service upon finalization and approval of plans and execution of necessary agreements in accordance with the Rules and Regulations." (SALDO Section 501.5.1)
- The Developer/Owner agrees that no further sanitary sewer construction shall proceed until an approved Planning Module or Waiver from the Department of Environmental Protection is received. (SALDO Section 501.5.2)
- The Developer/Owner agrees that no construction of improvements to the proposed shared low volume driveway including associated work to Airport Road shall begin until an approved Highway Occupancy Permit is received. (SALDO Section 501.6.8)
- The Developer/Owner shall enter into an Inspection Agreement with the Township and provide appropriate security. (SALDO Section 602.6)
The Inspection Agreement shall include the following:
- Provide a statement that the Township shall be held harmless against any claim of damage from any downstream property owners that may result from this proposed development. (Ordinance 98—2, Section 401.E)
- Provide a statement indicating the lot owners' responsibilities and liabilities regarding the maintenance of the storm water detention basin. (Ordinance 98—2, Section 401.M)
- The Developer/Owner shall pay all current fees, including any outstanding Plans and Appeals Account charges. (SALDO Section 602.1/605.10)
- The Developer/Owner shall provide ten (10) sets of prints for construction, prior to the start of construction, which contain a block for the Northampton County Uniform Parcel Identifier Number that are signed and notarized by the Owner and signed and sealed by the Engineer. (SALDO Section 602.4)
- The Developer/Owner agrees to meet all conditions of the Preliminary Plan approval, and the Developer shall submit a Record Plan and receive approval within twelve (12) months of conditional Preliminary Plan approval, and agrees that if such approval is not received, the conditional Preliminary Plan approval shall be considered void, and the application for Preliminary Plan approval shall be considered void and withdrawn.
The Developer/Owner further understands that the granting of conditional approval of this plan recognizes that the Township is agreeing to the following:
- That the Board of Supervisors waive the requirement that the Developer provide the identification and location of all existing trees and allow the identification and location of trees in the area of construction as shown on the plans with the understanding that additional existing trees will be identified and located prior to the start of Lot 1 and Lot 2 development. (Zoning Section 311.1/501.3.6a)
- That the Board of Supervisors waive the requirement that the Developer provide the designation of trees to be saved or removed and allow the designation of trees to be as shown on the plans with the understanding that the designation of trees to be saved or removed will be shown prior to the start of Lot 1 and Lot 2 development. (Zoning Section 501.3.6b)
- That the Board of Supervisors defer the requirement that the Developer provide a noise study until the development plans are submitted for Lot 1 and Lot 2. (SALDO Section 319)
- That the Board of Supervisors waive the requirement that the maximum allowable depth of water for the detention basin of 2.0', 3.0', and 4.0' for the 2 year, 10 year, and 100 year storms respectively and allow 2.62', 3.19' and 4.47' for the 2 year, 10 year and 100 year storms respectively. (Stormwater Management Ordinance 98—2, Section 401.I.7)
- That the Board of Supervisors waive the requirement that the minimum allowable slope for the bottom of the detention basin be 2% and allow the 1% shown on the plans. (Stormwater Management Ordinance 98—2, Section 401.I.10)
Mr. Colon further moved that the Township Secretary be authorized to notify the Developer of the Board's action.

Mr. Birdsall updated the Board relative to the St. Nicholas Church Improvements deadline. Mr. Birdsall stated that the Church has asked for a final inspection and no action needs to be taken tonight.
Mr. Salvesen closed the regular business meeting at 7:45 P.M. and opened the Public Hearing scheduled for Church on the Move Curative Amendment.
It is noted for the record that the Public Hearing has been duly advertised and the Secretary has proof of publication.
A court stenographer was present to record all testimony.
Mr. Salvesen closed the Public Hearing and re—opened the regular business meeting at 10:45 P.M.

Upon motion of Mr. Finnigan, seconded by Mr. Diacogiannis, the Board approved adjournment at 10:47 P.M.
